TERMS AND CONDITIONS

§1 General condition

  1. These Terms and Conditions regulate the rules of using the Internet Store https://senga-dance.pl by the Customers, and in particular they refer to:
    1. conditions of placing and order and sales execution
    2. regulations regarding providing services via Internet
    3. regulations for the use by the Customer the right to withdraw without a reason
    4. claiming rules and procedures
  2. Definitions:
    1. Internet Store – the Internet Store at the adress https://senga-dance.pl
    2. Service provider, seller, data administrator: Senga Agnieszka Malczyk, ul.Nowoursynowska 139a/2, 02-776 Warszawa, NIP 648-244-65-64, REGON 141753782, E-mail address: kontakt@senga-dance.pl
    3. Customer – non-corporate or corporate person, or an organization without legal personality, who benefits from the services provided by the Service Provider via Internet, who intends to, or already did, enter into a contract;
    4. Consumer – a person commiting with an enterpreneur legal actions not directly related to his/her business and professional activities;
    5. Order – enunciation by a Customer an intention to make a contract
    6. Service provided via Internet – a free of charge service referring to the availability of the order form for the Customer. In case of doubt, it is recognized that all actions undertaken by the Service Provider in order to properly fulfill the process, are also referred to as service provided via Internet.
    7. Price – the price that a customer is obliged to pay for the chosen products in case of concluding a contract. The price can be quoted in the following currencies: EUR. The given price is a gross price (including VAT). The prices in the Internet Store include the cost of shipment.
    8.  Delivery – entrusting by the seller to the third parties the products designated for the Customer. Delivery of the products the Seller entrusts only to the specialized courier companies, performing professional activity in that area.
  3.   4. A Customer of the Interned Store could be a non-corporate or corporate person, or an organization without legal personality, who benefits from the services provided by the Service Provider via Internet, who intends to, or already did, enter into a contract
  5. §2 Supply of services via Internet

  1. Within the activities of the Internet store, the Service Supplier commits herself to supplying the service via Internet within the range and under the conditions determined by these Terms and Conditions.
  2. Service via Interent is performed by the Service Supplier free of charge.
  3. Conditions of service perfomed via Internet:
    1.  Interactive form service:
      1. Contract for a service via Internet relying on providing an interactive form allowing to place an Order in the Internet Store is concluded at the moment of initiation of the usage of the above mentioned Service (Adding a product to the chart).
      2. Contract for a service via Internet relying on providing an interactive form allowing to place an Order in the Internet Store is concluded for a determined time, and is terminated at the moment of placing an order.
  4. The Service Supplier has a right to denounce the contract for supply of internet service with 7-days term of notice in case the Customer provides illegal contents.
  5. Withdrawal and termination of a contract does not refer to the rights already acquired by the Customers using the Interned Store of the Supplier.

§3 Sales Contract

  1. To conclude a sales contract, the Customer sends a request for information on availability of the product via the order form available at the website of the Internet Store. The Seller obliges herself to inform the Customer (via e-mail or via phone) on a possibility of making a purchase within 48 hours from sending the inquiry.
  2.  In case of receiving from the Customer a confirmation of his/ her willingness to make a contract, a confirmation is sent to the Customer’s e-mial address (including the price, the address, the mode of delivery, transfer details – if applicable), with a request for acceptance. Content of the message represents the offer (in accordance with the Article 66 par 1 of the Polish Cyvil Code) and constitutes a grounds for making a contract between the Customer and the Seller.
  3. The contract is made in case of acceptance of the offer by the Customer.
  4. The Seller proceeds an order after receiving a payment – in case of choosing the “Payment in Advance” option by the Customer.
  5. While placing an order, the Customer is obliged to confirm that he/she is familiar with, and accepts these Terms and Conditions.
  6. The Customer is obliged to provide the true data.
  7.  The Customer can cancel or modify the placed order. To do that, it is necessary to:
    1.  contact The Seller by phone
    2. contact The Seller via e-mail
  8. Orders are processed by the Customer Service Office of the Internet Store on work days (Monday – Friday), except National Holidays, between 9.00 A.M – 6.00 P.M. (GMT +1).
  9. Information published at the Internet Store pages cannot be considered as an offer in accordance with the Article 66 par 1 of the Polish Cyvil Code, but only are an invitation for inquiry, even though this information contains the price levels.

§4. Payment, delivery, collection:

  1. Payment
    1. Because of execution of the sale contract, the Customer is obliged to pay the price indicated in the order.
    2. The prices of particular products presented in the Internet Store are gross prices, expressed in EUR, including cost of shipment. For outside EU Customers: the prices do not include any costs related to the customs duties or taxes that are mandatory in the country of import. For detailed information regarding the import costs the Customer should contact the local Customs Office.
    3. Payment: telegraphic transfer to the account indicated by the Seller
    4. The price for the particular product becomes binding at the moment of placing an order by the Customer. The price for the ordered articles will not change even in case of a price change in the Internet Store that happened after placing the order by the Customer.
  2. Delivery
    1. Delivery is possible to any country around the World.
    2.  Lead time depends on the mode of delivery, but should not exceed 14 work days from the moment specified by § 3.4 of the Terms and Conditions.
    3. The Seller entrusts delivery of the products to the third parties performing professional activity in that area. The carrier’s details are provided by the Seller.
  3. Collection of the products
    1. The Seller informs, that the Customer has a right to check the condition of the parcel at the delivery to the indicated address. The check up needs to be done before collecting the parcel from the carrier.
    2. In case the Customer doing check up before collecting of the parcel from the carrier realizes the parcel is damaged, the carrier has an obligation to prepare the discrepancy protocol and investigate the circumstances in which the damage had happened. However, in most cases the carrier undertakes such actions based on the Customer’s claim.
    3. We hereby inform you that, in case of realizing damage that was not observable at the delivery, the Customer has a right to immediately ( but not later than 7 days from delivery date) claim for damages to the carrier.
    4. In case of any problems or questions, please contact the Seller at the phone number given at the Internet web page of the Seller.

§5 Personal Data

  1. Completion of the data in the Order Form is equivalent with consent to processing the Personal Data of the Buyer by the Seller, and by the party entitled by the seller to manage the content of the web page, which the Internet Store is integral part of, in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 is a regulation in EU law on data protection and privacy for all individuals within the European Union and the European Economic Area . Personal data of the Buyer will be processed to proceed the placed order, including invoicing and financial reporting. The data is confidential, and will not be disclosed to unauthorized persons.
  2. The Personal Data of the Buyer is protected by the Data Administrator in accordance to the above mentioned regulation regarding Personal Data Protection, and will not be forwarded, sold, nor lent to any third parties or institutions that are not authorized. The Personal Data of the buyer will be disclosed to fulfil the contract for sale of the Products covered by these Terms and Conditions.
  3. Access to the Personal Data has only the Data Administrator.
  4.  Customer who completed the Order Form has a right to access his Personal Data for verification, modification, or to request its removal from the Personal Database, by contacting the Data Administrator in writing at: Senga Agnieszka Malczyk, ul. §6 Complaints

  1. Complaints of purchased items:
    1. The Seller bears responsibility towards the Client according to the regulations defined in the civil code bill (23 April 1964) |(Journal of Laws No 16, position 93 with amendments) as well as in other common law regulations.
    2. In case the purchased item bears traces of incompatibility with the agreement or features defects, the Client should inform the Seller about it, and in case of need, deliver the advertised good to the Seller’s following address: Senga Agnieszka Malczyk, ul.     3. In case the purchased item bears traces of incompatibility with the agreement or features defects, the Client should inform the Seller about it, and in case of need, deliver the advertised good to the Seller’s following address: Senga Agnieszka Malczyk, ul.       1. Complaint examination is executed immediately within the period of 14 days,
      2. Reply concerning complaint will be sent to the address given by the Client or in any other way defined by the Client,
      3. The Seller informs that in case of items covered by a guarantee, the entitlements are to be executed according to the conditions defined in the guarantee card. The guarantee for a purchased item does not exclude, limit, or suspend Client’s entitlements against the Seller’s responsibilities as defined by the civil code bill (23 April 1964) (Journal of Laws No 16, position 93 with amendments).
    4.  In order to facilitate proceeding of complaint the Client is entitled to use the complaint form provided by the Seller.
  2. Complaints concerning electronic services of the Internet Shop:
    1. Complaints concerning electronic services of the Internet Shop should be sent to the following e-mail address: kontakt@senga-dance.pl or via mail to the following address: Senga Agnieszka Malczyk, ul. Nowoursynowska 139a/2, 02-776 Warszawa, NIP 648-244-65-64, REGON 141753782,
    2.  In order to expedite and facilitate the process of complaint examination, it is advised that the letter defined in point 1 includes information concerning e-mail address, the type of defect and the date of its occurrence as well as agreement details.
    3. Examination of complaint concerning electronic services is executed immediately within the period of 14 working days.
    4. Reply concerning complaint will be sent to the e-mail address given by the Client or in any other way defined by the Client.

§7 Withdrawal from the contract:

  1. The Client being the consumer as understood in the article 22[1] of the civil code (23 April 1964) |(Journal of Laws No 16, position 93 with amendments) who has concluded a distance agreement has the right to withdraw from it by putting in an appropriate statement within the period of 14 days. The defined period will be respected as long as the statement is sent before the end of this period. The statement may be sent to the following address: Senga Agnieszka Malczyk, ul.   2. The 14-day period during which the Client may withdraw from the sales agreement or electronic service agreement is counted from the day of issuing the item in case of sales agreement, or from the day of signing the agreement in case of electronic service agreement.
  3. Immediately after receiving the statement informing about the withdrawal from the agreement, the Seller replies to the Client via e-mail message with confirmation of receiving the aforementioned statement.
  4. In case of withdrawal from the agreement, the sales agreement or electronic service agreement is considered unsigned. The provisions of both sides are returned in intact state unless changes were necessary to prove the nature, features or functioning of the item; also, § 7.7 may be applied. The item should be returned immediately, within the period of 14 days.
  5. The Seller will execute reimbursement of payments received from the Client via the same way as the Client used to pay for the item unless the Client distinctly agrees to other way of reimbursing which does not charge them with any additional costs. The Seller may suspend the reimbursement until receiving the purchased items or delivering the proof of sending them by the Client, depending on which of the two occurs first.
  6. The Client merely bears direct costs of returning the itemst to the Seller.
  7.  If the Client decides on a way of returning the items to the Seller other than the cheapest way of delivery offered by the Seller, the Seller therefore is not obliged to reimburse any additional costs born by the Client.
  8. The Client bears responsibility for decreasing the value of items being a result of using them in a manner exceeding the necessary means of defining the nature, features or functioning of the items.

§8 Item exchange:

  1.  If the Client wants to exchange the item to another one, they should inform the Shop about it within the period of 30 days from the day of receving the item via e-mail to the following e-mail address: kontakt@senga-dance.pl
  2. The Client should send the exchanged item to the address of the Internet Shop with the exchange form and original purchase document attached to it to the following address: Senga Agnieszka Malczyk, ul. Nowoursynowska 139a/2, 02-776 Warszawa, NIP 648-244-65-64, REGON 141753782.
  3. The Client bears the costs of delivering the exchanged item to the Seller.
  4. After receiving the exchanged item together with exchange form and purchase document by the Seller, the Seller sends the item indicated by the Client in the echange form, at the same time bearing the costs of the delivery. In case the indicated item is inaccessible, the Seller reimburses the received payment to the bank account number indicated by the Client.
  5. In case the item exchanged to another one is cheaper, the difference in price between the two shall be covered by the Client via sending the sum constituting the difference to the Seller’s bank account number.
  6.  In case the item exchanged to another one is more expensive, the difference in price between the two shall be covered by the Seller via sending the sum constituting the difference to the bank account number indicated by the Client.
